These Terms of Service (“Terms”) govern your use of CallRescue, a communication assistance service operated by WHIPLASH LLC (“Company”, “we”, “us”, or “our”).

By using the Service, you agree to these Terms.


1. Service Description

CallRescue provides automated communication assistance tools designed to help businesses respond to inbound callers when they are unavailable.

The Service may send SMS messages to callers based on missed call activity or call routing configurations provided by the user.

CallRescue acts solely as a technology platform enabling users to communicate with their own customers.


2. No Guarantee of Results

CallRescue does not guarantee:

  • delivery of any message

  • receipt or response by any caller

  • increased bookings, sales, or revenue

  • prevention of lost customers

  • uninterrupted or error-free operation

Users acknowledge that telecommunications networks, carriers, device compatibility, call routing setup, and external factors may affect performance.


3. User Authorization & Sender Responsibility

By using CallRescue, you represent and warrant that:

  • you are authorized to use and connect the phone numbers submitted

  • you authorize automated follow-up messages to be sent to inbound callers on your behalf

  • you are the sender of all communications transmitted using the Service

  • you are solely responsible for compliance with all applicable laws, including TCPA and telecommunications regulations

CallRescue does not control customer consent obtained through inbound calls.


4. Setup & Configuration Responsibility

Service performance depends on proper call forwarding, routing, phone system compatibility, and accurate information provided by the user.

Users are solely responsible for:

  • correctly configuring call forwarding or routing

  • maintaining active carrier service

  • ensuring device or phone system compatibility

  • providing accurate business information

CallRescue is not responsible for failures caused by incorrect setup or telecom provider limitations.


5. Telecommunications & Carrier Limitations

Users acknowledge that:

  • messages may be delayed, filtered, blocked, or undelivered

  • carriers may change policies at any time

  • message throughput and timing are not guaranteed

  • telecommunications outages may occur

Carriers are not liable for delayed or undelivered messages.


6. Acceptable Use

Users may not use CallRescue to:

  • send spam or unlawful communications

  • impersonate another business

  • mislead or defraud recipients

  • violate telecom regulations or privacy laws

We may suspend or terminate accounts for misuse.


7. Billing, Refunds & Cancellation

CallRescue is billed as a recurring subscription.

Users may cancel at any time by contacting support.
Cancellation takes effect at the end of the current billing period.

No refunds or prorated credits are provided for partial use, setup issues, telecom limitations, or perceived lack of results.

Failure to use the Service does not relieve payment obligations.


8. Limitation of Liability

To the fullest extent permitted by law, WHIPLASH LLC shall not be liable for:

  • lost revenue

  • missed business opportunities

  • customer disputes

  • telecommunications failures

  • indirect, incidental, consequential, or punitive damages

Total liability shall not exceed the amount paid by the user in the preceding 30 days.


9. Indemnification

Users agree to defend, indemnify, and hold harmless WHIPLASH LLC from any claims, damages, fines, regulatory actions, or legal expenses arising from:

  • use of the Service

  • telecom compliance violations

  • customer communication disputes

  • inaccurate information provided by the user


10. Service Changes & Availability

We may modify, suspend, or discontinue the Service at any time without liability.

Features, integrations, or messaging behavior may change due to carrier policies or technical requirements.


11. Arbitration & Dispute Resolution

Any dispute arising from use of the Service shall be resolved through binding arbitration in the State of Texas.

Users waive the right to participate in class actions or jury trials.


12. Governing Law

These Terms are governed by the laws of the State of Texas.
